GENERAL TERMS AND CONDITIONS OF USE (GTCU)

PREAMBLE

The company SAGA AFRICA HOLDINGS LIMITED SA (hereinafter “YAS”), a public limited company with share capital of 14 349 000 000 FCFA, registered with the Dakar Trade and Companies Register SN DKR 1098 B 1094 with registered office at 15, Almadies – Route de Ngor, BP 146, Dakar, has developed the mobile application “APP TELCO” (hereinafter “the Application”) enabling users to access:

  • Electronic communications services offered by YAS or its affiliates;
  • Data/voice passes, bundles and value-added services settled by direct carrier billing (DCB) with the partner operator;
  • Third-party content and services listed (games, education, streaming, etc.) offered by Partenaires YAS.

Any installation or use of the Application constitutes unreserved acceptance of these GTCU and, where applicable:

  • The General Terms of Sale (GTS) applicable to each YAS offer;
  • The terms of use specific to each listed third-party service.

These GTCU may be updated; continued use following an update constitutes acceptance.

ARTICLE 1 – KEY DEFINITIONS

Term Brief Definition
Biometric Authentication Validation of an operation via the device’s native facial recognition (Face ID) or fingerprint recognition (Touch ID). YAS does not collect or store biometric data.
Code confidentiel / OTP One-time code (4–6 digits) sent by SMS or push notification to secure access or a transaction.
Mixx By YAS Mobile money wallet offered by YAS to settle purchases or receive refunds, where applicable.
DCB Payment method by deduction from telecom credit.
Partenaire YAS Third-party provider of content, goods or services listed in the Application.
Utilisateur An adult individual residing in Senegal, with a compatible mobile device and a mobile line from YAS Senegal operator.
Carte SIM Refers to the microprocessor card inserted into the User’s mobile device enabling identification across mobile networks. This may be SIM, Micro SIM, Nano SIM, or e-SIM.
Electronic Communications Operator Mobile operator authorised in Senegal.
Partenaires SAGA AFRICA HOLDINGS LTD-SA Natural or legal person whose service is listed in the Application.
SMS Text message of up to 160 characters sent following a transaction or notification.
Transaction Any payment transaction carried out via the YAS application.

ARTICLE 2 – OBJECT

  1. The installation, access and use of the Application;
  2. Subscription to YAS services and Partner services;
  3. Security, confidentiality and conduct rules.

ARTICLE 3 – INSTALLATION & ACCOUNT CREATION

  1. Compatibility: Android 8+, iOS 14+, Harmony OS 3 or later.
  2. Download: Google Play, App Store or AppGallery.
  3. Activation: OTP verification and account creation process.

Terms & Conditions

  • Customers should give their correct information only, by filling in and signing the device loan form.
  • Customer must pay initial deposit first before taking the mobile phone.
  • In case of failure to self-pay, TIGO will deduct the daily fee amount from your Tigopesa account.
  • Loan Repayment
    • You will be deducted from the amount you have skipped or due direct from your Tigopesa.
    • If payment is not made in time, the expected repayment will be deducted from your Tigopesa account.
    • You proceed with manual repayment through USSD Main menu *147*00# or Tigopesa App.
  • Upon an event of default, customer agree for any one or more of the following actions to be exercised:
    • Lock the device which will prevent from using any of the device functionality.
    • Require to immediately pay the outstanding unpaid amount financed.
    • A locked device can only be unlocked by paying the outstanding via Tigopesa app only.
  • For every repayment customer will receive his/her daily offer of MBs and if not, offer will be received.
  • The device will remain to be owned by HONORA TANZANIA PUBLIC LIMITED COMPANY unless the loan is completed.
  • You will be able to get another loan if you have completed your loan and your tenure for loan.
